The Texas Abortion Law Is Back In Court

Today is not only the one month anniversary of SB 8, the Texas Heartbeat Bill. It's a day that the bill will be challenged again in court.

"The federal judge in Austin is going to have a hearing on whether the Biden-Harris administration can sue the state of Texas, and block enforcement of the Texas Heartbeat Bill" said Dr. Joe Pojman, executive director of Alliance For Life, "We don't know when that judge will rule? It could be immediately, or it could be in a matter of days."

If you remember, the U.S. Supreme Court refused to block the law from going into effect last month. Now, the Biden administration is going to try again at the lower level U.S. District Court with an Obama appointed judge, Robert L. Pitman.

"If the judge does block enforcement of this law" Dr. Pojman told KTRH, "The Attorney General of Texas, Ken Paxton who is very pro-life, will appeal to the 5th Circuit Court of Appeals, and they have already hinted that the state of Texas cannot be sued to block this law."

Why is that? Because of the way SB 8 was written. The bill cannot be enforced by the state of Texas, it's enforced by private citizens, making it tough to hold up in court.

"They don't have any right to be in the courtroom, this doesn't involve the state of Texas defending the law" Dr. Pojman said, "The state of Texas cannot be sued, and the law cannot be blocked by the federal court."

All of which is true. But as we've seen multiple times over the last 8 months under the Biden administration, laws, rules, and especially the constitution, don't mean anything if you just ignore them, and continue to get away with it.
