Lack of Evidence: Suspect in Child's Death Released

Charges have been dropped against an ex-Marine accused of killing 11-year-old Josue Flores.

The Harris County District Attorney's Office made the announcement Tuesday afternoon -- citing lack of evidence.

Officials said Andre Jackson will be freed from the Harris County Jail and won't be tried for the boy's killing.

Flores' family reportedly agreed with the DA's Office that Jackson should not be prosecuted based on the best information available.

Flores, a student at Marshall Middle School who loved science and math, was killed in May while walking home form school.
