Texas will take your blood if you refuse a breath test
Civil liberties advocates worry about Texas' "No Refusal" DWI campaign. But the Supreme Court has ruled in its favor.
Houston attorney Chris Tritico says it's legal to take your blood by force if you refuse a breath test.
"Yes, the Constitution does allow the police to take blood against your will if they comply with the requirements of the 4th Amendment."
Tritico says he's torn on the issue, but on a night like this...
"But I see a situation on a night like New Year's Eve where the authorities can say 'this is the night, if any, that we're gonna do this.'"
Because of success here, no refusal weekends are becoming popular in other states.
