Convicted murderer has paranoid schizophrenia.

49 year old Steven Staley has been diagnosed as a paranoid schizophrenic who's severe symptoms have caused three previous execution dates to be withdrawn because he can't understand the real reason he's being put to death.

Staley has been the subject of a court order to force medication on him which Death Penalty Advocate Dudley Sharpe thinks is perfectly okay.

"That's legal, so if that's what the courts have approved then he can be executed," says Share.

But civil rights attorney Randall Kallinen thinks Staley's case may have questions of constitutionality.

"The question then becomes is it constitutional to forcibly medicate a mentally ill death row inmate to make him competent enough to be executed," says Kallinen.

Staley is set to be executed on May 16th.
