Texas is Suing the EPA!

It's all about the federal smog control plan.

This lawsuit against the EPA states that it exceeded the authority that is given to the agency with the plan it's creating to reduce ozone emissions that cross state lines. The plan would control the air that flows from industrial facilities (like power plants, chemical plants etc) that drifts from one state to another.

It would require Texas along with many other states, to cut their emissions from these sources they say could contribute to ozone pollution in their neighboring states.

The petition was filed in the 5th U.S. Circuit Court of Appeals. It was submitted by the State of Texas, the Public Utility Commission of Texas, the Railroad Commission of Texas and the Texas Commission on Environmental Quality.

The lawsuit was filed by Interim Attorney General John Scott.
