Professor Says Affirmative Action’s Days are Limited

A constitutional law professor at the South Texas School of Law says he expects the upcoming U.S. Supreme Court decision to end affirmative action.

“The Supreme Court,” professor Gerald Treece says, “is right at the precipice of putting the last nail in the coffin of Affirmative Action.”

The court heard oral arguments on Fisher v. University of Texas last October.  Professor Treece says he expects a decision before the high court’s current session ends next month.

He expects the ruling to go against the University of Texas, 5-3, with Justice Elena Kagan recused.  “(The University of Texas) gave too much emphasis to race in its decision,” says Treece.

That decision threatens to uproot affirmative action programs at the public colleges and universities in the U.S.
